Elon Musk is being investigated by federal authorities, Twitter informs judge

According to a court filing filed by Twitter, Elon Musk is under federal investigation for his conduct in connection with the $44 billion acquisition of Twitter, and Twitter says he “has exchanged substantive correspondence with those authorities concerning their investigations through counsel.”

The lawsuit says he is under investigation but does not specify what type of investigation is underway or which federal agencies are conducting it, but “This ‘hide the ball’ game must end,” Twitter said in the court filing.

Twitter’s lawyers said in an October 6 letter to Judge Kathaleen St. Jude McCormick, who is leading the company’s case against Musk, that they had been requesting documents related to Musk’s investigation since July 22.

“Elon Musk is currently under investigation by federal authorities for his conduct in connection with the acquisition of Twitter. He has exchanged substantive correspondence with those authorities regarding their investigations through counsel,” the lawyers wrote.

According to Twitter, Musk’s lawyers submitted a “privilege log” in late September that includes documents to be withheld, including a draft email to the Securities and Exchange Commission (SEC) dated May 13 and a slide presentation to the Federal Trade Commission (FTC).

Musk’s lawyer Alex Spiro said Twitter’s court filing was a “misdirection” and “it is Twitter’s executives who are under federal investigation.”
